This policy explains how the personal data of people who visit this website or contact El Descanso is processed, in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

2. What data is processed and how it is obtained

This website has no forms, user registration, comments or shop, and does not store data about the people who visit it. Personal data only reaches us when you decide to contact El Descanso by phone, by email or by WhatsApp:

Contact details: name, phone number and email address.
Enquiry or booking details: dates, number of people and any information you choose to include in your message.

If the stay is confirmed, the traveller details required by regulations will be requested before arrival (see section 4). These details are not requested through this website.

3. What it is used for

Answering your enquiries about the accommodation, prices and availability.
Managing your booking and communication during your stay.
Complying with the accommodation’s legal obligations (traveller register, tax and accounting obligations).

No automated decisions are made and no profiles are built, and the data is not used to send advertising.

4. Legal basis

Handling your enquiry: the application of pre-contractual measures at your request and your own consent when you write or call (Art. 6.1.a and 6.1.b GDPR).
Managing the booking and the stay: performance of the accommodation contract (Art. 6.1.b).
Traveller register and tax and accounting obligations: compliance with legal obligations (Art. 6.1.c), including Royal Decree 933/2021, which requires recording the details of the people staying.

5. How long it is kept

Enquiries that do not lead to a booking: kept for as long as needed to deal with them and deleted, at the latest, one year after the last contact.
Bookings and stays: during the contractual relationship and, afterwards, for the legal retention periods and limitation periods for liabilities.
Traveller register: the period set by regulations (three years).

6. Who the data is shared with

The data is not sold or passed on to third parties for commercial purposes. It is only disclosed when the law requires it, for example to the security forces (traveller register) or to the tax authorities.

To provide the service, providers who process data on behalf of the controller are involved:

Hostinger, which hosts this website and the contacto@eldescansoainsa.com mailbox.
WhatsApp (Meta), if you choose to write through this app. Its terms and privacy policy are those of that service, and it may involve data transfers outside the European Economic Area under its safeguards.

If you book through a third-party platform, such as Booking.com, the processing of your data on that platform is governed by its own privacy policy.

7. Technical data of the website

As on any website, the server technically records the IP address, the date and the page requested in order to ensure the operation and security of the site. This site does not use analytics or advertising cookies, nor does it include third-party tracking tools (see the Cookie Policy). The fonts and the map on the contact page are served from the site itself.

8. Your rights

You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability by writing to contacto@eldescansoainsa.com and stating which right you wish to exercise. If the processing is based on your consent, you may withdraw it at any time, without affecting what has already been done.

If you believe your data has not been processed correctly, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

9. Security

Reasonable technical and organisational measures are applied to protect the data: encrypted connection (HTTPS), administration access protected with two-step verification, regular updates and backups. Contact details are not stored on this website.

10. Minors

This website is aimed at adults. Bookings are made by people of legal age.

11. Changes to this policy

This policy may be updated, for example if a contact form or an online booking system is added. The current version will always be published here.
